WOMAN of ACTION – Trisha Smith

A Celebration of Women

is extremely moved in the Celebration of this Life, the Life of a Woman that has survived ‘terror’, worked diligently to Heal and Recover so to devote the balance of her Life helping others. However the trauma of not having the law to charge the crime is what my story and life is about.

~~~Take Action~~~
against one of the most horrific crimes of humanity,
DOMESTIC VIOLENCE.
Trisha Smith is an educator; at an early age she worked for the UN Conference ‘HABITAT ’67’ as a Coordinator and Advocator for Canadian Youth Letters & Arts. Trisha is a writer and an artist for magazines and education, and in the aftermath of being violated of her human rights of not having a law to charge a crime committed against her by another Canadian, outside Canada, Trisha Smith authored her own tragic story in her book, HOLIDAY in HELL. Trisha has been a life-time published writer and artist, raised two daughters, and is a grandmother of two grandsons. Trisha’s passion is oil painting and to have her tragic story made impact on a visual through an international film production.
WOMAN of ACTION
Trisha Smith
Trisha Smith is a teacher, artist, and a writer.
In her own words:
“I love music and it is a wonderful healer…my friends who are artists know me how I was healing and I thank God that I am able to also go on one day to continue to finish my collection in oil paintings.
And my courage comes from the voices of my young Canadian students,
the public, the old and the new friends,
my family – my two grandsons,
and especially my heart could never be at peace as I hear about others who go through the devastation of their life when there’s no law for them to be protected, to be consoled, and vindicated and their case becomes labeled as ‘complicated’.
“There were no coincidences in what happened to me and the thereafter coincidences that I could write about more.”
For example, my story was continuing as I was hearing news such as Mr. Baig, a judge who defended the two women from Barrie, they were being charged for the murder of a Canadian couple killed in Mexico, just 2 years ago. At that time, Judge Baig, also had no choice but to label that case as a ‘complicated case’. Why? Is is because as Canadians the Judicial System does not provide us the law to charge a crime outside the borders of Canada. CCC6(2)
She knew that there was no law, this is why she gave me a note on the airplane to get in touch with her when I will need her to affidavit. Was she prompted because of her humanity? Yes, Laurel and I spend some time during that vacation in Cuba as total stranger having wonderful conversations about our Canada and the global impacts on us.Neither one of us knew at that time that she’ll become the missing link to create a precedent setting case in the Canadian Supreme Court of Canada. But again and again, I’m tired of it telling: Nevertheless, the crime against me was never charged!
Trisha’s inquisitiveness took her into research, interviews, and writing at Ecology Canada Magazine, and then for other publications.
While working under the Secretariat of State as a Bilingual Coordinator, Ms. Smith compiled Canadian youth’s artistic works for the United Nations Conference, “Habitat ‘76” Exhibit, in Vancouver.
Ms. Smith illustrated educational publications, books, and others. Her legal advocacy has become the subject of 14 newspaper articles (the Toronto Star) and several TV news shows (CITY-TV).
TRISHA’S STORY:
Imagine a wonderful holiday vacation in an exotic tropical resort,
surrounded by friends and the man you love.
Imagine relaxing,
away from work and the tedium of life in cold Canada, not a care in the world…
Imagine being wakened in the middle of the night
by a punch to the face and a man screaming,
“I’ll kill you, I’ll kill you.”
Marisha has been victimized once, now the violation is doubled as Raffaele walks away scott free, the Canadian authorities telling her that they can do nothing.
“Her life shattered and in pieces….”
“The crime happened in Cuba, they have no jurisdiction….”
Basically, they leave the injured woman in a wheelchair on the curb and walk away.
Holiday in Hell is the story of one Woman’s struggle for Justice in a System that did not foresee such an event. It documents her pain, her fear and her disappointment as every avenue is blocked, every person in authority saying,
I found the story compelling and important. Sometimes there is no change unless the victim takes a stand. Marisha’s strength stems her from family and friends. They don’t let closed doors stop them and they use the media to press the fight. It documents the court battles, the defeats and the small victories along the way.
After the crime committed against me by another Canadian in Cuba, my legal advocacy became 10 years ago the subject of 14 newspaper articles (the Toronto Star) and several TV news shows (CITY-TV)
and involving the External Affairs,
the local police and full investigation of how this crime can becharged in Canada.
Holiday in Hell is a true story, tragedy, drama, and relentless suspense chronicling years of author’s life.
Holiday in Hell serves as a wake-up call to Canadians, however conveys hope that Canadian Criminal Code 6(2) can be amended because even though my case in the Supreme Court of Canada became a precedent setting, however the issue still stands that a crime committed by a Canadian upon another Canadian, outside Canadian borders, cannot be charged in Canada.
Canadians, like myself, are setting the wheels in motion to amend a jurisdictional law for the Canadian justice system to grant their citizens a jurisdictional protection that extends beyond “diplomats, victims of aircraft hijacking, hostage taking, protection of nuclear materials, torture, war crimes, piracy” to the entire Canadian population and my story is just that.
He is (was since he just died or cancer) the father of Laurel Baig, my Affidavit Witness in my Story.
Laurel went on to become an international criminal lawyer, defending the Rwanda Crime Tribunals. (Please see her name comes up in my book. ) She knew that there was no law, this is why she gave me a note on the airplane to get in touch with her when I will need her to affidavit.
  1. This blog was… how do I say it? Relevant!! Finally I’ve found something
    that helped me. Thanks a lot!
  2. Hello Trisha,
    Thank you for sharing your story.
    I noticed this post on facebook to raise awareness and offer support from domestic violence.
    I would love to speak with you please about what you are doing and see how I can support you and your cause.
    I live in Australia. I have a Not For Profit Organisation entitled: Generational Change Foundation and one of the things that we do is to support victims of domestic violence.
    Hoping to chat soon.
    Stacey
  3. Hello Everyone and special thank you to Catherine Anne,
    I’m posting below an update to my links as the latest one is http://trishasmith.tumblr.com/ representing the continuous support received and this one is one of few done lately by Facebook, since my return to Facebook.
    Just a note, that the worst violent impact on me, my family, friends and my High School students was and still is the fact that there’s still no law for ALL CANADIANS to be able to charge crime committed by another Canadian against them, abroad! This is why the support for my mission goes on…
    ALL CANADIANS should be protected under the INTERNATIONAL HUMAN RIGHTS and in this light it is for the Canadian government to update THE CANADIAN CRIMINAL CODE 6(2) to provide for ALL Canadians to be able to charge another Canadian who commits a crime against them, outside Canada.
    At the end of my book I ask Canadians to join me to CALL THE CANADIAN GOVERNMENT TO STAND UP TO AMEND THE CANADIAN CRIMINAL CODE 6(2) as it says: A Canadian cannot charge another Canadian of a crime committed against them outside the border of Canada! THANK YOU!
    Please write a letter to The Prime Minister of Canada and to The Minister of Justice in respect to my case which gained precedent-setting however the crime against me committed by another Canadian was never charged!
  4. hello we have come a long way but the laws are outdated and they were made by men. I think that if the laws were made with the idea of protecting the human race and also this beautiful earth..then people would not be oppressed and abused of and the earth would not be pillaged and dirtied with garbage from the industrial and agricultural business…and on and on..but since the whole foundation is based on greed and often oppression and control we have laws that do not take care as a decent father and mother should sort of speak…
    i think that we as people need to be helpging each other..and if this man is still roaming around, people should know where he is..and he should learn a lesson..but since we as a human race have learned to be too individualistic…then the bad person keeps his freedom ..i have heard of cases in other 3 world countries where the people take justice in their hands and beat the killer…i know i sound mean but i am just saying that there is a balancing point where bad boys need to pay and the people need to accountable and not sleep walking..
    i would like to learn from you because you may have been hurt in many ways but how about all the other injustices ,,they are deep and wide for example where they give the power to doctors and people in uniform (even when they damage people’s lives) just because they are protected by the system ….i think that we need to change this protection of medical communities and blue chip companies that damage land etc…there needs to be people power and laws that will protect people and earth and punish the offenders.
  5. hank you Tammy, Carole, Cinda, and Cindasi,
    Please forgive me for not showing my appreciation to your encouragement in word, which compels me to keep on ROARING for hours!!!
    Your words definitely confirm what I just read in Luke 18:2-5…
    In a certain town there was a judge who neither feared God nor cared abot men. And there was a widow in that town who kept coming to him with the plea, ‘Grant me justice against my adversary.’
    For some time he refused, ‘Even though I don’t fear God or care about men, yet because this widow keeps bothereing me, I will see thaqt she gets justice, so that she won’t eventually wear me out with her coming!’
    And this can only happen with your love!
    I need help to have a mission statement – so far this is it what you see here below. If anyone can help me with it, please email me at visual_means@hotmail.com. Also, I will be contacting IMAGINE Canada to find out if the foundation would also help me to set up a foundation since I don’t have the money to do so.
    JUST CAN continues to educate people about Trisha Smith’s story Holiday in Hell, to procure an amendment of The Canadian Criminal Code 6(2) legislated in the Canadian laws to read, ‘A Canadian can charge another Canadian of a crime committed against him/her, abroad.’
    JUST CAN became as a private foundation on the principle of the issues arising from when a crime was committed against Trisha Smith (a grave bodily injury assault) abroad, in Cuba, Trisha was unable to charge the crime on the Cuban soil, even though she made a declaration of the crime with witness, since she and the perpetrator is a Canadian, nor was she able to charge the Canadian perpetrator of the crime committed against her, in Canada.
    JUST CAN devotes itself to provide victims of crime with a support system with other agencies, as well. The pioneer work of JUST CAN began by Trisha Smith, who in 1999, when Trisha became a victim of a brutal crime in Cuba, she was not able to charge in Canada or in Cuba the other Canadian. Her ‘complicated’ case is a violation of her human rights as a Canadian citizenship in the international Human Rights Court.
    JUST CAN continues the goal to further develop the infrastructure of communication with the Canadian governments, local MP Councils, and The Justice System to deliver the importance to enable Canadians to be able to charge other Canadians of crimes committed against them, abroad, without any exceptionalities, due to the fact that the Petitions of the Canadian citizens, when they were tabled at the House of Commons in 2001 to have The Canadian Criminal Code 6(2) amended, were rejected.
    JUST CAN believes that public knowledge and support is a powerful weapon, especially in a time of elections of political parties. JUST CAN has a goal to have Trisha Smith’s story, Holiday in Hell, produced into a documentary film.
    JUST CAN is a premise to mission of Trisha Smith’s book, Holiday in Hell, as an account for the long ran to support the needs which will arise in the CA– USE to amend The Canadian Criminal Code. The book, Holiday in Hell, as the anchor, is to first raise awareness.
    JUST CAN as a legal private foundation having a charitable status so that donations are tax receipt-for their donors. The goal for fundraising is to generate finances for future projects – such as communicating with the government – documentary film, and any other legal issues – whether women’s, child or men, any of them which will arise in the fabric of our Canada’s development in the global world.
    JUST CAN has top rate respectable board of directors who provides support for the Women that our World needs in these times…as Abuse in so many forms is epidemic at this generation, in both in Western & Eastern Cultures; and rampant in the Third World.
    Subject: Domestic Violence:
    In the United States 1 in 3 woman are in abusive situations and many who look for help and resources only find that they have to walk away from everything and begin again. How when woman give themselves to another in marriage many of these men feel they own their wives and their wives are possesions and not people who can think and feel for themselves. I belive there are many more woman who are being victimized who are on disabilty like myself because they are hidden from society . I want to find a way to get out of my situation so I can be a change to empower other women abled or disabled alike to show them they are valuable and there is hope and noone needs to be controlled and life is not about being sad but about living and being who each one of us were created to be and that is beautiful and powerful.
  9. What a brave and wonderful soul Trisha is. She is ROARing all the way to justice, Hurrah!!! I role model for sure, let no other woman and even child be mistreated by those that are supposed to love them most.
