A Celebration of Women

is extremely moved in the Celebration of this Life, the Life of a Woman that has survived ‘terror’, worked diligently to Heal and Recover so to devote the balance of her Life helping others. However the trauma of not having the law to charge the crime is what my story and life is about.

DOMESTIC VIOLENCE.

Trisha Smith is an educator; at an early age she worked for the UN Conference ‘HABITAT ’67’ as a Coordinator and Advocator for Canadian Youth Letters & Arts. Trisha is a writer and an artist for magazines and education, and in the aftermath of being violated of her human rights of not having a law to charge a crime committed against her by another Canadian, outside Canada, Trisha Smith authored her own tragic story in her book, HOLIDAY in HELL. Trisha has been a life-time published writer and artist, raised two daughters, and is a grandmother of two grandsons. Trisha’s passion is oil painting and to have her tragic story made impact on a visual through an international film production.

Trisha Smith is a teacher, artist, and a writer.

“I love music and it is a wonderful healer…my friends who are artists know me how I was healing and I thank God that I am able to also go on one day to continue to finish my collection in oil paintings.


And my courage comes from the voices of my young Canadian students,

the public, the old and the new friends,

my family – my two grandsons,

and especially my heart could never be at peace as I hear about others who go through the devastation of their life when there’s no law for them to be protected, to be consoled, and vindicated and their case becomes labeled as ‘complicated’.

“There were no coincidences in what happened to me and the thereafter coincidences that I could write about more.”

 

For example, my story was continuing as I was hearing news such as Mr. Baig, a judge who defended the two women from Barrie, they were being charged for the murder of a Canadian couple killed in Mexico, just 2 years ago. At that time, Judge Baig, also had no choice but to label that case as a ‘complicated case’. Why? Is is because as Canadians the Judicial System does not provide us the law to charge a crime outside the borders of Canada. CCC6(2)

She knew that there was no law, this is why she gave me a note on the airplane to get in touch with her when I will need her to affidavit. Was she prompted because of her humanity? Yes, Laurel and I spend some time during that vacation in Cuba as total stranger having wonderful conversations about our Canada and the global impacts on us.Neither one of us knew at that time that she’ll become the missing link to create a precedent setting case in the Canadian Supreme Court of Canada. But again and again, I’m tired of it telling: Nevertheless, the crime against me was never charged!

Trisha’s inquisitiveness took her into research, interviews, and writing at Ecology Canada Magazine, and then for other publications.

While working under the Secretariat of State as a Bilingual Coordinator, Ms. Smith compiled Canadian youth’s artistic works for the United Nations Conference, “Habitat ‘76” Exhibit, in Vancouver.

Ms. Smith illustrated educational publications, books, and others. Her legal advocacy has become the subject of 14 newspaper articles (the Toronto Star) and several TV news shows (CITY-TV).

TRISHA’S STORY:

Imagine a wonderful holiday vacation in an exotic tropical resort,

surrounded by friends and the man you love.

Imagine relaxing,

away from work and the tedium of life in cold Canada, not a care in the world…

Imagine being wakened in the middle of the night

by a punch to the face and a man screaming,

 

“I’ll kill you, I’ll kill you.”

Marisha has been victimized once, now the violation is doubled as Raffaele walks away scott free, the Canadian authorities telling her that they can do nothing.

“Her life shattered and in pieces….”

“The crime happened in Cuba, they have no jurisdiction….”

Basically, they leave the injured woman in a wheelchair on the curb and walk away.

 

Holiday in Hell is the story of one Woman’s struggle for Justice in a System that did not foresee such an event. It documents her pain, her fear and her disappointment as every avenue is blocked, every person in authority saying,

 

 

I found the story compelling and important. Sometimes there is no change unless the victim takes a stand. Marisha’s strength stems her from family and friends. They don’t let closed doors stop them and they use the media to press the fight. It documents the court battles, the defeats and the small victories along the way.

 

After the crime committed against me by another Canadian in Cuba, my legal advocacy became 10 years ago the subject of 14 newspaper articles (the Toronto Star) and several TV news shows (CITY-TV)

and involving the External Affairs,

the local police and full investigation of how this crime can becharged in Canada.

Holiday in Hell is a true story, tragedy, drama, and relentless suspense chronicling years of author’s life.

Holiday in Hell serves as a wake-up call to Canadians, however conveys hope that Canadian Criminal Code 6(2) can be amended because even though my case in the Supreme Court of Canada became a precedent setting, however the issue still stands that a crime committed by a Canadian upon another Canadian, outside Canadian borders, cannot be charged in Canada.

Canadians, like myself, are setting the wheels in motion to amend a jurisdictional law for the Canadian justice system to grant their citizens a jurisdictional protection that extends beyond “diplomats, victims of aircraft hijacking, hostage taking, protection of nuclear materials, torture, war crimes, piracy” to the entire Canadian population and my story is just that.
